General Terms

This website, www.npouches.com (the “Website”). The Website is available for purchases by consumers aged 21 years or older residing in the USA. Please review these terms of sale (“Terms”) carefully as they govern your purchase of products from npouches and contain important information about limitations and exclusions that may apply to you.

By placing your order, you confirm that you have read, accepted, and agreed to comply with these Terms. You also acknowledge that you have read and understood the Privacy Policy.

NPouches reserves the right to change these Terms at any time. Any changes will be published on the Website and will apply to you upon placing a new order.

Ordering Products from the Website

NPouches offers nicotine products available on the Website from time to time. The images of the products are for illustrative purposes only, and the products may vary slightly from those images.

By placing an order with NPouches, you represent and warrant that you are a consumer, at least 21 years old, and have a delivery address in the USA.

Please note that NPouches may impose a maximum limit on the number of cans per customer within a certain time frame as set out on the Website. We reserve the right to refuse and/or revoke an order due to such limitations and/or limit quantities in any order at our sole discretion. When we have accepted your payment, confirmed your order through a confirmation email to the email address you provided when placing the order, and dispatched the products, the purchase agreement will be concluded.

Age Verification and Prevention of Youth Access

At NPouches, we enforce a strict age limit of 21 years, although state laws may permit a lower age requirement. To place an order, you will be required to verify your age through our third-party vendor for on-site age verification (Agechecker). If verification fails and/or public records don't align, you must upload a valid and unexpired government-issued ID for extended age verification. npouches may deny and/or cancel the order if proper identification cannot be provided and/or age verification cannot be completed.

In addition to confirming your age, you, as the cardholder, must be 21 years or older to complete the transaction. An order made in another person’s name (falsification of a document), or in any other way that causes to risk financial damage, will be reported to the relevant authorities. We reserve the right to refuse an order if irregularities or misuse of our order function are suspected.

Product Information

NPouches strives to ensure all information provided on the Website is correct, but we reserve the right to account for limited availabilities and possible errors in pictures or writing, such as errors in product descriptions, incorrect prices, or erroneous information about stock availability. We reserve the right to correct such errors at any time and change or update information. All pictures on the Website are intended as illustrations only and do not guarantee the exact appearance or condition of the product.

Price and Payment

The prices listed on the Website before checkout are base prices, to which applicable taxes will be added. You may also be eligible for discounts as offered from time to time by NPouches. All prices, fees, and charges (e.g., adult signature requirement (ASR) fee, shipping fees, and taxes) on the Website are displayed and charged in USD ($). An additional fee may be charged for an unredeemed package.

Before completing your order at checkout, you must choose the delivery method, after which the costs for your order, including ASR fee, shipping costs, and applicable taxes, including sales taxes and State Excise Tax (SET), based on your location, will be calculated and added.

We provide payment options via debit or credit cards through our partners MasterCard, Visa, American Express and Discover. The respective payment service provider’s terms and conditions apply to the payment. By using a payment method, you represent and warrant that you are authorized to use that designated payment method. If you are not eligible for the chosen payment method, e.g., if your debit or credit card cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled automatically.

Shipping

Due to certain state regulations governing the online sale of tobacco and nicotine products, NPouches is unable to deliver to every state in the USA. The available shipping options and the shipping costs for each option will be presented at checkout on the Website. The shipping cost is specified during checkout when placing an order. You will view the shipping cost in your order summary at checkout.

You will receive a shipping confirmation once your order has been dispatched from NPouches’ warehouse. We strive to ship all orders promptly. However, it may take a few days before you receive the shipping confirmation email.

Certain states require adult signatures upon delivery in addition to on-site age verification. If this requirement applies in your state, you acknowledge that NPouches’ shipping carrier will attempt delivery up to three times. You agree that if delivery is unsuccessful, your package will be returned to NPouches at your cost.

A package shipped according to any of our delivery alternatives will either be sent back to NPouches or discarded if you have not been able to redeem it. You agree to pay any costs associated with an unredeemed package.

Returns

We do not accept returns since our products are fresh with a limited shelf life. However, if there was a problem with your order or if the product doesn’t meet your expectations, you can contact our customer service team to request a refund. The right to complain only includes defects at delivery (not defects due to the product’s expired shelf life or normal wear and tear). You need to notify NPouches about the defect within ten days after receiving the product. We recommend you inspect the products carefully upon receiving them. Please note, the time frame for compensation to be issued for orders is 10 days.

Depending on the type of product defect, we may require you to provide photographic proof. Throughout the complaint period, you are required to retain the original packaging, packing slip, and the products in question.

Depending on the type of defect, we may provide a replacement product, remediation, or a price reduction. For further claims exceeding the cost of the product, NPouches agrees to comply with mandatory applicable consumer legislation governing the purchase. Any other liability is expressly excluded.

Title to the product passes from us to you upon shipment, and we are not responsible for any shipping delays or problems once the product has been shipped. However, in the event of damages during shipment, you may reach out to our Customer Service team, and we will try to assist you. We kindly ask you to keep the product packaging for inspection. To make a claim regarding your products, you will also need to prove your purchase from the Website, such as through the order confirmation or the receipt npouches sent to the email address you provided when making your purchase. We may also request photographic proof of damages.

Events Outside Our Control

NPouches is not required to comply with these Terms when there is an event outside of our control (Force Majeure), including, for example, changes in legislation, government measures, strikes, blockades, sabotage, war, terrorism, fire, floods, natural disasters, epidemics, or other extraordinary events. Such an event will also relieve NPouches from the obligation to pay any compensation to you. If a Force Majeure event lasts longer than two (2) months, both you and NPouches have the right to cancel the purchase with immediate effect.

Product Reviews

By submitting a product review on the Website, you give NPouches the right to publish it on the Website and other channels and media. NPouches also reserves the right not to publish or to delete any submitted review.
